1. Acceptance of Terms

3. Subscription Plans and Payments

fixtheirsite offers various subscription plans. By selecting a paid subscription, you agree to pay the subscription fees indicated for your selected plan. Fees are due in advance and will be billed to the payment method you provide during registration. Unless otherwise stated:

• Subscription fees are charged on a recurring basis (monthly or annually, depending on your plan)
• Subscriptions automatically renew unless you cancel before the renewal date
• No refunds or credits will be provided for partial periods of service, downgrades, or unused time with an active subscription

We may change our subscription fees at any time. If we do, we will provide notice of the change on our website or by email at least 30 days before the change takes effect.

4. User Content

Our Service allows you to upload, store, share, and manage information about your leads and business contacts ("User Content"). You retain all rights to your User Content, but you grant fixtheirsite a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, and distribute your User Content solely for the purpose of providing and improving the Service.

You are solely responsible for your User Content. You represent and warrant that:

• You own or have obtained all necessary rights and permissions to use and share your User Content
• Your User Content does not violate any copyright, trademark, or other intellectual property rights of any third party
• Your User Content does not violate the privacy or other rights of individuals whose information you include
• You have obtained proper consent for collecting, using, and storing information about individuals in compliance with applicable laws

5. Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Use the Service to spam, harass, or harm others
• Upload or transmit viruses, malware, or other malicious code
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use automated means or scripts to access or scrape data from the Service
• Use the Service to collect sensitive personal information without proper consent

8. Termination

You may terminate your account at any time by canceling your subscription through your account settings or by contacting us. Upon termination, your right to use the Service will immediately cease, but all provisions of these Terms that by their nature should survive termination shall survive.

9. Limitation of Liability

To the maximum extent permitted by law, in no event will fixtheirsite, its affiliates, directors, employees, agents, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability to you for all claims exceed the amount you have paid to fixtheirsite in the 12 months preceding the event giving rise to the liability.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

fixtheirsite does not warrant that: (a) the Service will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.

11. Indemnification

You agree to defend, indemnify, and hold harmless fixtheirsite, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding relating to your access to or use of the Service shall be brought exclusively in the federal or state courts located in San Francisco County, California, and you agree to submit to the personal jurisdiction of such courts.

13. Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or, if that is not possible, the provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by fixtheirsite on the Service, constitute the entire agreement between you and fixtheirsite concerning the Service and supersede all prior agreements, understandings, representations, and warranties, both written and oral, regarding the Service.
